In England, a small sewage discharge can operate without an environmental permit only when all of the general binding rules that apply to it are met. The daily volume limit is one condition, not a complete compliance test. Emptying paperwork on its own does not establish that the discharge meets the rules.

For discharge to ground, the sewage must be domestic in nature and the daily volume must be no more than 2 cubic metres, alongside the other applicable conditions. Septic-tank effluent must pass to a suitable drainage field and must not discharge directly to a watercourse. The rules also differ according to when the discharge started or changed, and separate arrangements apply outside England.

Maintenance and system condition

The system must be operated and maintained correctly. Sludge must be removed before it exceeds maximum capacity, with desludging at least annually or in line with the manufacturer’s instructions. A maintained tank can still fail the rules if the discharge route, location, capacity or condition does not meet the applicable requirements.

Changes to the property or discharge

Changes in discharge volume, location or route can alter which rules apply. Extra accommodation or a change in use can also increase the load on the system. An earlier description of the installation should not be treated as proof that the current discharge still meets every applicable condition.
